General
terms of trade and delivery

1. Ambit
Our general terms and conditions apply to all business relations between
apimanu company, Ltd. (in the
following text named "apimanu company") and the customer. General terms and conditions apply at
their version valid at the time of the order. Special conditions
requested by the customer require the approval of apimanu company,
Ltd.
2. Conclusion of contract
All of our special offers are not-binding. A contract between apimanu company and the customer is concluded, when the order placed by the customer
has been accepted and confirmed by apimanu company. The order of the
customer is to be placed by filling out and transmitting the provided order
form via internet. apimanu company sends acceptances of the order by
e-mailing confirmation of the order to the customer. apimanu company is
neither obliged to accept the offer, nor to process the order, in case there
is writing errors or legal mistakes in the website.
3.
Delivery
Product, that is in stock (we are not liable for transportation problems),
is ready for dispatch within 2 to 5 business days. In case the product is
not in stock, we take great effort to deliver as soon as possible. In case
of breach of delivery terms which are due to higher power, labor dispute,
unpredictable obstacles or other circumstances, the time for delivery will
be extended adequately. In case of breach of delivery terms due to other
reasons than mentioned above, the customer may set an adequate extension of
delivery time accompanied by a threat of refusal. In case the extended
delivery date did expire also, the customer becomes entitled to withdraw
from the contract agreement. If the impossibility of the delivery is based
on incapacities by the manufacturer or our supplier, apimanu company as well
as the customer may withdraw from the contract, provided that the arranged
date of delivery has exceeded 2 months. In case the customer already had
paid for the product, we will give her/him a refund promptly. Claims for
compensation due to delay or impossibility or non-fulfillment, also those
that occur in association with a withdrawal from the contract, are
impossible. This regulation applies, unless a lawful representative of the
firm "apimanu company" has acted intentionally or coarsely
negligently.
Unfortunately, we cannot influence possible delays of delivery caused by the
parcel delivering company, hence are not reliable for their delays. The
delivery is performed to the delivery address provided by the orderer. Our
gift service offers to you: Shipping of product to the gift recipient and
mailing of the bill to the orderer. Is the product ordered by you not
available with us, we will inform you promptly. We do not deliver to the
following countries: Iran, Iraq, Afghanistan, Lybia, Sudan. This applies
also to diplomatic orders.
4. Return policy
We will refund you with the purchase price less a flat handling charge of 10
Euros, provided that you had no success with the ordered product. "Fair
play" applies to both parties. For this reason the reimbursement
depends on the following conditions: 1. The user must apply the product in
accordance with apimanu company's recommendation. 2. Within 3 days after
receiving the product, before the beginning of taking the product, you
should be examined by a specialist and be attested the investigation results.
You may send this certificate to us within 2 days after investigation
date. During the last day of taking the product and finishing the containers
contents, visit a doctor again in order to be examined and attested once
more of the results after the completion of product intake. Please
send this certificate to us promptly, at the latest 2 days after
investigation date of the certificate. In case the results of the second
certificate show no improvement of the condition stated in the first
certificate, we will refund you with the paid purchase price, less a flat
handling charge of 10 Euros. In case appointments of date hit weekend-days,
Monday applies as the appointment of date. The customer is liable for
potential additional expenses arising associated with conditions as
mentioned above.
5. Amount restriction
Our product is determined only for sale to the end user - not for reselling.
Hence we reserve the right to dispatch our products only in a small amount
for the individual. In case your order may exceed our limits, we will inform
you via e-mail.
6. Terms
of payment and shipping expenses
The minimum order value is 35,- Euros. Payments can be maid as directed in
the online order form. The forwarding expenses-all-inclusive depends
on the payment method selected by the customer. In case the order value
drops to less than 35,- Euros due to a return, we reserve the right to
charge the customer for shipping. apimanu company reserves the right to
deactivate certain payment methods temporarily or longterm, in case
technical difficulties apply. All prices are final prices in EURO and
include value added tax. Prices apply in the amount mentioned at actual
point of order. Payment is due with the delivery of the ordered product, at
the latest. In case of credit card payment, the payment information will be
transferred to the credit institute one week after delivery of the product.
7. Retention of title
The product remains our property until completion of payment process.
8.
Warranty and liability
Claims beyond conditions as described under paragraph 4, in particular the
customers claims for indemnity, are not accepted. Exceptions may apply only
beyond paragraph 4 and are typically not accepted. The user of the product
should, in any case, consult a doctor before ordering and, in any case,
before taking in the product. This as a measure to discuss possible side
effects, compatibility and allergies associated with the individual
ingredients of our product.
9.
Buyers risk
Potential risks are transferred to the customer, as soon as shipping has
been initiated by apimanu company.
10. Data privacy
To process the order successfully it is necessary for the orderer to provide
her/his related data. The data required from the customer for the commercial
processing is stored securely within the scope of the proper execution of
the order processing and may be transmitted to a third party if necessary.
The treatment of the data occurs according to the regulations of the data
security law (Datenschutzgesetz) and the tele service data security law
(Teledienstdatenschutzgesetz). All personal data is being treated
confidentially. We are committed to protecting your data against any
unauthorized access. To retrieve more information regarding data security
you may access the tab "Security". For the purpose of credit check
and monitoring the credit history we reserve the right for data exchange, if
necessary. Your protection-worthy interests are taken into consideration.
11.
Court of juristiction
For commerce with merchants and juridical persons of the public right, the
court state for legal disputes is arranged for in Gibraltar.
For concerns of end users, the residence court of the end user is also
responsible for contractual disputes.
For end user concerns regarding consumer rights, the right to use residence
court is applicable.
12. Final regulations
In case particular regulations of these general terms of trade should not be
applicable, the remaining regulations ARE yet effective. The relevant lawful
regulation supersedes the ineffective regulation. Only
Gibraltar law is
applicable to this contract and is untouched by the UN-purchase right.

Copyright
Copyright by apimanu company. The pages of apimanu company's shop are
protected by copyright law. Imitation, even by extract only, is permitted
exclusively with approval by apimanu company.
